Mitsubishi Electric
Advising in relation to claims for breach of contract concerning work done in establishing the train system to be used by the Bangkok Metro.

Former Manager of Davis Hotel
Representing the former manager of the Davis Hotel, a boutique hotel in Bangkok, in a claim for unfair termination of an employment contract.

California Fitness
Advising in relation to claims of unfair termination brought by over 20 employees dismissed for misappropriation of funds.

Former Manager of Stock Broker Company
Representing the former manager of one of Thailand’s largest online stockbroker company’s against criminal charges for misappropriation of funds.

Bangkok overhead railway share pledge enforcement
Acting for Schroders as Facility Agent in the enforcement of a share pledge over a 23% stake in the BTSC Overhead Railway by public auction. This was one of the highest profile enforcements in Thai corporate history. We successfully defended an injunction motion aimed at stopping the auction.

JACO claim for breach of concession
Acting for JACO, concessionaire for the operation of an online lottery system, in terminating the concession and claiming damages against the government lottery organisation.

Power plant construction dispute
Acting for a major Thai private power generator in the successful resolution of a dispute concerning the construction of two power blocks.

Finance One defence of former management
Defending a member of the former management of Finance One against criminal claims brought by the Bank of Thailand for breach of Bank of Thailand regulations. This was the first case brought by the Bank of Thailand against a former executive of the suspended finance company.

Euro Iseki dispute
Acting for Euro Iseki in its dispute with the Noss consortium comprising North West Water, Sinothai and Siam Syntech over non-payment. The claim was complicated by a dispute between North West Water and the Bangkok Metropolitan Administration.

SITCARS securitisation litigation
We have acted for MBIA Insurance, the monoline insurer, on this auto receivables securitisation. The matter has involved a number of civil and criminal lawsuits in which we have acted. This case is the first time a securitisation structure has been considered by the Thai courts and represents a test case on the enforceability of securitisation structures. The suspension and subsequent bankruptcy of one the originators has added to the complexity of the litigation.

Public company auditor defence
Defending a senior public company auditor in relation to SEC de-licensing proceedings. This matter was one of the first cases in which severe disciplinary action was taken against a public company auditor by the authorities. It followed public demands for action in relation to the collapse of the 56 finance companies.

Jurisdiction of the Intellectual Property and International Trade Court
Advising on a test case on the jurisdiction of the new Intellectual Property and International Trade Court. This case was brought before the Supreme Court to determine whether a foreign bank acting through its Bangkok International Banking Facility could sue a borrower in the new Court. The Supreme Court ruled in favour of bringing the action in the new Court.

Telecom Asia
Acting for Telecom Asia in relation to a dispute with TOT relating to its concession and the revocation of a cabinet resolution.
